The petitioner seeks bail in Harlakhi P.S. Case No. 120 of 2017 registered under Sections 414, 401, 411, 412, 413 and 120B of the Indian Penal Code.

Three accused persons including the petitioner were apprehended by the police with the stolen motorcycle in the course of checking of vehicle.

It is submitted by learned counsel for the petitioner that the petitioner happens to be a pillion rider and had boarded the said motorcycle taking lift from its driver, namely, Pramod Kumar Das. He has no concern with the aforesaid stolen motorcycle. No incriminating article has been recovered from his conscious physical possession.

Patna High Court Cr.Misc. No.50254 of 2017 (2) dt.17-10-2017 2/2 languishing in custody since 19.07.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Madhubani in connection with Harlakhi P.S. Case No. 120 of 2017.
