The petitioner, already in custody, seeks bail in connection with Kahalgaon (Ghogha) P.S.Case No. 709 of 2017 registered under Sections 379 and 411/34 of the Indian penal Code.

Allegation in brief is that petitioner was apprehended with stolen motorcycle.

Submission is that motorcycle was not recovered from his possession and he has been falsely implicated in this case and has been in custody since 28.01.2018.

Whereas learned counsel for the State submits that stolen motorcycle was recovered from the possession of the petitioner. Having considered the aforesaid facts and circumstances, presently the prayer of bail of the petitioner is rejected. However, trial court is directed to expedite the trial and

Patna High Court Cr.Misc. No.40797 of 2018(2) dt.10-07-2018 2/2 conclude the same preferably within six months. If the same is not concluded within six months, petitioner may renew his prayer of bail.
