JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 09-06-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Sadar P.S. Case No.417 of 2018 registered for the offence punishable under Sections 399, 402 and 414 of the Indian Penal Code and Section 25(1-b)A, 26 and 35 of the Arms Act. On receiving a confidential information to the effect that some miscreants had assembled to commit a serious crime, the police are said to have conducted a raid leading to arrest of four persons (not this petitioner). From their possession country made pistols and cartridges were recovered. Some persons had managed to flee away. Those apprehended are said to have disclosed the names of such persons, who had fled away including the petitioner's name.

No.18811 of 2020(2) dt.09-06-2020 2/2 Learned counsel for the petitioner has submitted that co-accused Mayank Kumar, who was apprehended and from whose possession certain incriminating articles were recovered, has been allowed regular bail by this Court, by order dated 03.07.2019 passed in Cr. Misc. No. 24461 of 2019. He has further submitted that some other persons, similarly situated, have been allowed regular bail by this Court. The petitioner is in custody since 26.11.2019.

Considering the above, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned XI Additional Sessions Judge, Muzaffarpur, in Sadar P.S. Case No. 417 of 2018.
