The petitioner apprehends his arrest in connection with Malaypur P.S. Case No.58 of 2021 registered under Sections 272, 273 and 34 of the Indian Penal Code and Sections 30(a), 36 and 41(i) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner. The petitioner is not the owner nor the driver of the said vehicles and he has no concern with the wine business for selling or purchasing. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances

Patna High Court CR. MISC. No.17683 of 2023(3) dt.19-05-2023 2/2 of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Exclusive Special Excise Court I, Jamui in connection with Malaypur P.S. Case No.58 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
