This application under Section 482 of the Code of Criminal Procedure has been filed on behalf of the petitioner to quash the entire proceedings of Case No.M 1/3070 of 2012 as also the order dated 27.08.2013 passed in Case No.M 1/3070 of 2012 in a proceeding under Section 146(1) of the Code of Criminal Procedure, whereby the Sub Divisional Magistrate, Hajipur, attached the land in dispute and appointed the Officer Incharge, Kartahan, as a Receiver.
3. On going through the impugned order, I find no illegality therein amounting to an abuse of the process of the court, calling for interference in an extraordinary jurisdiction of this Court
Patna High Court Cr.Misc. No.49873 of 2013 dt.07-04-2016 2/2 under Section 482 of the Code of Criminal Procedure.
4. Accordingly, this application stands dismissed. However, the Sub Divisional Magistrate, Hajipur, is directed to conclude the proceedings expeditiously, preferably, within one year. (Rajendra Kumar Mishra, J) P.S./- U T
