JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420,406,467,468,471 and 419 of the Indian Penal Code.
It is alleged that the petitioner illegally claimed to be the Mahanth of Rajauli Sangat, a registered trust registered with the Bihar Religious Trust Board and sold the land of the said trust without taking necessary permission of the Bihar Religious Trust Board, Patna.
It is submitted by the learned counsel for the petitioner that petitioner is working as Mahanth of the alleged trust in pursuance to the order passed in Second Appeal No. 81 of 2003. More over, the petitioner has not executed any sale deed nor the
Patna High Court Cr.Misc. No.25063 of 2015 (2) dt.30-06-2015 2/2 details of any sale deed have been brought on record. Considering the nature of accusation in the background of dispute with regard to the appointment of the Mahanth by Religious Trust Board, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nawada in connection with Rajauli P.S. Case No. 58 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
