The petitioner apprehends his arrest in Kursela P.S. Case No. 124 of 2021, registered for the offences punishable under Sections 307, 393 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, all the FIR named accused persons demanded ransom and caused firearm injury to the driver of the vehicle (informant).

It is submitted that petitioner is not named in the FIR. Name of petitioner transpired in this case on the basis of confessional statement of co-accused Rikesh Kumar and there is no tangible material to show his complicity in the alleged occurrence. Petitioner has got clean antecedent.

No.17645 of 2022(2) dt.29-08-2022 2/2 Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Kursela P.S. Case No. 124 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
