JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Mojahidpur (Babarganj) P.S. Case No. 85 of 2018 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. The petitioner is in custody in connection with seizure of 5 litres country made liquor from the joint house of the petitioner. He submits that co-accused Diwakar Choudhary has been granted bail vide order dated 29.06.2018 in Cr. Misc. No. 38185 of 2018.

Considering the fact that the petitioner has no criminal antecedent and the similar circumstanced co-accused has been granted bail, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees
