JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-07-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Parbatta P.S. Case No. 35 of 2018 for the offenses under Sections and Section 30(A), 38(i) of the Bihar Prohibition & Excise Act, 2016 and Sections 25(1-b) A, 26, 35 of the Arms Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 29.03.2018. Counsel further submits that three persons were apprehended by the police and out of three persons two were released by the court below and only the petitioner is still in custody.

Considering the fact that similarly circumstanced

No.38768 of 2018(2) dt.09-07-2018 2/2 other co-accused have been granted bail in connection with recovery of 750 ML bottle half empty and three bottles each containing 375 ML and one semi automatic pistol, let the petitioner, above named, be enlarged on bail after 20.7.2018 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (Excise), Bhagalpur in connection with Parbatta P.S. Case No. 35 of 2018.
