The petitioner seeks regular bail in connection with Giriak PS case no. 426 of 2018 registered for the offence punishable under Section 379 of Indian Penal Code. The allegation is regarding recovery of stolen motorcycle from the house of the petitioner.

The learned counsel for the petitioner submits that for the same incident, two cases were registered, one bearing Giriak PS case no. 426 of 2018 and the other bearing Silao PS case no. 238 of 2018. It is further submitted that in Silao PS case no. 238 of 2018, one Anuj Kumar was arrested by the police and he had disclosed that the petitioner was involved in the business of dealing with stolen motorcycle and upon a

Patna High Court CR. MISC. No.16692 of 2019(2) dt.02-04-2019 2/2 raid having been conducted in the house of petitioner, the stolen motorcycle was recovered. It is further submitted that apart from the aforesaid case, the petitioner is an accused in one other case but he has already been granted bail in the aforesaid case. The petitioner is said to be languishing in custody since 29.11.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Judicial magistrate-I, Nalanda at Biharsharif in connection with Giriak PS case no. 426 of 2018.
