The petitioner seeks bail in a case registered under Section 414 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.
Allegation is that one country made pistol along with one live cartridge and one motorcycle are recovered. It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.12.2019 and has got no criminal antecedent. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. One country made pistol along with one live cartridge and one motorcycle are said to have been recovered. Patna High Court CR. MISC. No.14721 of 2020(2) dt.02-03-2020 2/2 in question is stolen property. There is no compliance of Section 100 of Cr.P.C.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., 1st class, Muzaffarpur in connection with Siwai Patti P.S. case No.178 of 2019.
