The petitioners apprehend their arrest in a case registered under sections 447, 323, 380, 504/34 of the Indian Penal Code. According to the F.I. R. allegation against the petitioners is that they assaulted the informant and took away his belongings after entering into his house.
It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. It is further submitted that from perusal of the impugned order it is evident that the police during investigation submitted charge sheet showing the petitioners as not sent up for trial but the leaned court below after differing with the police report took cognizance of the offence. It is further submitted that the petitioners have no criminal antecedents.
Patna High Court Cr.Misc. No.25478 of 2015 (2) dt.14-07-2015 2/2 On behalf of the State it is submitted that petitioners are named in the first information report.
Considering the aforesaid facts the above named petitioners in the vent of their arrest or surrender before the court below within a period of four weeks from the date of receipt /production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in Harsidhi P.S. Case No. 124 of 2012, subject to the conditions as laid down under section 438(2) Cr.P.C.
