The petitioner is languishing in custody in connection with Sultanganj P.S. Case No. 198 of 2015 for the offences instituted under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

There is allegation against the petitioner that he along with other co-accused persons committed murder of the younger brother of the informant.

It has been submitted on behalf of the petitioner that petitioner is in custody since 05.02.2016. Charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses against the petitioner. Petitioner is not named in

Patna High Court Cr.Misc. No.22082 of 2016 (4) dt.02-08-2016 2/2 the F.I.R. His name has come on the basis of confessional statement of co-accused. Other co-accused have been granted bail vide Cr. Misc. No. 18648 of 2016, Cr. Misc. No. 19116 of 2016 & Cr. Misc. No. 22889 of 2016.

On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Bhagalpur, in connection with Sultanganj P.S. Case No. 198 of 2015.
