Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defect(s) as pointed out by the office when called upon to do so by the office. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 307 and 379 of the Indian Penal Code. It is a case of shot firing upon the informant by the accused persons.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there is case and counter case between the
Patna High Court CR. MISC. No.27239 of 2021(2) dt.31-01-2022 2/2 parties and no specific allegation of firing against this petitioner. He further submits that there is no injury inflicted upon the body of the informant and his father.
Learned APP appearing for the State has opposed the prayer for anticipatory bail.
In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Hilsa (Nalanda) in connection with Chandi P.S. Case No. 208 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
