03.09.2020 Nobody appears on behalf of the petitioners.

The State is represented by Mr. Satyavrat Verma, learned APP. The petitioners seek bail in anticipation of their arrest in connection with Jaynagar P.S. Case No. 85 of 2014 dated 02.06.2014 instituted for the offence under Sections 403, 406, 420, 364 and 34 of the Indian Penal Code.

It appears that the informant was given money by the Government for construction of her house, which was misappropriated by the petitioners.

It has been submitted on behalf of the petitioners that they are the nephews of the complainant. There appears to be some dispute between the parties for not returning the accommodation loan which was granted by the informant.

Considering the nature of accusation and the relationship between the parties, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) each with two sureties of like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Madhubani in connection with Jaynagar P.S. Case No. 85 of 2014, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

However, since this order has been passed in the absence of the counsel for the petitioners, the order will be given effect to only if the petitioners have not been arrested.
