====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-03-2025 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 304, 504, 506/34 of the Indian Penal Code.
3. As per the prosecution case, dead body of the son of informant was lying in the field due to electrocution. In the meantime, all the F.I.R. named accused persons including this petitioner and 4 to 5 unknown persons came there and tried to take away the dead body from the field.
4. Learned counsel appearing for the petitioner submits that the death of informant's son is accidental due to electrocution. Allegation against the petitioner is vague and he has falsely been implicated in the case with a view to extract money. It is further submitted that similarly situated co-accused
Patna High Court CR. MISC. No.17504 of 2025(2) dt.19-03-2025 2/2 has already been granted anticipatory bail by this Hon'ble Court vide order dated 04.04.2024 passed in Cr. Misc. No. 21379 of 2024. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. II, Patna City in Gaurichak P.S. Case No. 574 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
