This is an application for bail in connection with Punpun P.S.Case No. 206 of 2017 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. Allegation as per FIR is that there was indiscriminate firing by accused persons, including the petitioner on the deceased and it is said that petitioner was armed with katta. Submission of learned counsel for the petitioner is that though there is allegation indiscriminate firing but post mortem report, which has been annexed in supplementary affidavit filed today, shows that only one injury was found on the person of deceased and there is no specific allegation against the petitioner and she is in custody for five months.
Patna High Court Cr.Misc. No.53355 of 2017 (3) dt.17-11-2017 2/3 Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail stating that there is recovery of one DBBL gun from the house of co-accused Upendra Gop as the house of both the petitioner and Upendra Gop is their joint house and she is kingpin of the occurrence. Having heard both sides and in view of facts and circumstances, let the petitioner being lady, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Masaurhi, in connection with Punpun P.S.Case No. 206 of 2017, subject to the following conditions :
(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner shall co-operate in trial and appear on each and every date in court, failing which her bail bond shall be cancelled.
