JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-06-2020 Heard Mr. Ramesh Kumar Singh, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Khagaria (Chitragupta Nagar) P.S. Case No. 957 of 2019, dated 29.12.2019, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Regard being had to the nature of accusation and
Patna High Court CR. MISC. No.14796 of 2020(2) dt.29-06-2020 2/2 the criminal antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to him.
The prayer for grant of anticipatory bail is, accordingly, rejected.
However, if the petitioner surrenders before the Court below and seeks regular bail, the Court below shall consider the same in correct perspective, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
