====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 09-11-2017 Heard Sri Hans Lal Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Runnisaidpur P.S. Case No.297 of 2017 registered for the offence under Sections 30, 30(g), 38(I)(II) of the Bihar Prohibition and Excise Act,2016, has prayed for grant of bail, in the event of his arrest or surrender.

Learned counsel for the petitioner submits that save and except confessional statement of co-accused, which was made before the police, there is no other material to connect the petitioner and the petitioner is having clean antecedent. This fact has been stated in paragraph-3 of the petition. Considering the fact that the petitioner has been made accused on the basis of confessional statement, which was made

No.50885 of 2017(2) dt.09-11-2017 2/2 before the police, as well as clean antecedent, let the petitioner, namely,Raja Kumar @ Rajgir Kumar, in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned I/C A.D.J.-II, Sitamarhi in connection with Runnisaidpur P.S. Case No.297 of 2017, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
