====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-10-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioner apprehends his arrest in connection with N.H. Bangara P.S. Case No. 33 of 2018 registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code.

Petitioner happens to be brother of co-accused Santosh Kumar Sah who is said to have kidnapped the victim. So far as petitioner is concerned, it is only stated that he helped the coaccused in the alleged crime. The victim has not been recovered as yet but submission on behalf of the petitioner is that victim as well as

Patna High Court CR. MISC. No.19760 of 2020(4) dt.14-10-2020 2/2 co-accused were in love and they fled with each other and settled at some place which is not known to the petitioner and moreover, petitioner does not have any concern with the affairs of co-accused.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Samastipur in N.H. Bangara P.S. Case No. 33 of 2018, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
