====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-06-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offence punishable under Section 7 of the Essential Commodities Act.

Petitioner is alleged to be involved in black marketing of fertilizers and when raid was conducted, 102 bags of urea was seized.

Learned counsel appearing for the petitioner submits that petitioner is a licensee dealer at IFFCO and has not violated any condition. None of the customers have complained against him that he was illegally selling the fertilizer. It is further submitted that the F.I.R. does not reflect which order has been violated by the petitioner.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Itarhi P. S. Case No. 08 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
