The petitioner is apprehending his arrest in connection with Gopalpur P.S.Case No.122 of 2018 , registered for offences punishable under Sections 302, 201, 120(B)/34 of the Indian Penal Code.

Prosecution story discloses that the informant received informant that his niece was killed by his brother-in-law and his second wife and the petitioner is also named in the FIR. Submission of the learned counsel for the petitioner is that the petitioner is brother of the second wife of Brajesh Kumar and except suspicion there is nothing against the petitioner and the second wife and other accused persons have been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court, vide order dated 3.10.2018 passed in Cr. Misc. No.60924 of 2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the court below within a period of six weeks from the date of receipt of order and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM XI, Patna in connection with Gopalpur P.S.Case no.122 of 2018 (G.R.No.3415 of 2018), subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that he will co-operate in the investigation of the case.

With the aforesaid direction, this application is allowed.
