The petitioner seeks bail in Parbatta P.S. Case No.218 of 2016 registered under Section 307 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act. Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected vide order dated 27.04.2017 passed in Cr. Misc. No.9442 of 2017 with an observation that the petitioner may renew his prayer for bail after remaining nine months in custody. The petitioner is in custody since 03.01.2017. Petitioner has already remained in jail for ten months.

Considering the fact that the firing was hit in the thigh of the son of the informant for which the petitioner has remained in

Patna High Court Cr.Misc. No.50773 of 2017 (2) dt.01-11-2017 2/2 jail for ten months, the petitioner, above named, is directed to be released on bail on his furnishing bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Parbatta P.S. Case No.218 of 2016.
