Petitioner apprehends arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code and Section 3 of the Prevention of Damage of Public Property Act, 1984.

As per F.I.R., some unknown miscreants committed theft of electric wire.

Learned counsel appearing for the petitioner submits that petitioner is not named in the F.I.R. His name transpired during course of investigation and he has been made accused only on the basis of suspicion. No stolen article has been recovered from possession of the petitioner.

Considering the facts and circumstances of the case,

Patna High Court CR. MISC. No.16619 of 2023(2) dt.19-05-2023 2/2 this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Khagaria in connection with Pasraha P. S. Case No. 58 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
