This is an application for bail in connection with Fathehpur P.S.Case No. 230 of 2015 registered for the offences punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code.

Allegation against the petitioner and four other accused persons, including 2-3 unknown persons is of firing and causing death of deceased.

Submission of learned counsel for the petitioner is that informant is not an eye-witness to the occurrence and he has falsely been implicated in this case and he has been made accused on the basis of suspicion and he is in custody since 14.7.2017. Heard learned APP also.

Having heard both sides and in view of facts and

Patna High Court Cr.Misc. No.50327 of 2017 (3) dt.13-11-2017 2/2 circumstances, as stated above, and though there is no eye-witness to the occurrence but at this stage, I am not inclined to grant bail to the petitioner.

However, this application is disposed of with a direction to the trial court that once charge has been framed against the petitioner, learned trial court will release the petitioner on bail to its own satisfaction with condition that petitioner will co-operate in trial.
