The petitioners are in custody in connection with Kalyanpur P.S. Case No. 77 of 2018 for the offence under Sections 272, 273, 414 of the Indian Penal Code and Section 30(a), 47 of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners submits that the petitioners have no criminal antecedent and they are in custody since 20.05.2018 in connection with 97.5 liters liquor. Learned counsel submits that similar situated co-accused have been granted bail by this court in Cr. Misc. No. 37579 of 2018 vide order dated 28.06.2018.
Considering the aforesaid fact the petitioners, named
Patna High Court Cr.Misc. No.40430 of 2018(2) dt.10-07-2018 2/2 above, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned 6t h Additional Sessions Judge-cum-Special Judge, Excise, Samastipur in connection with Kalyanpur P.S. Case No. 77 of 2018.
