Petitioner seeks bail in Sessions Trial No.713 of 2017 arising out of Belchhi P.S. Case No.11 of 2017 instituted for the offence under Section(s) 394, 302/34, 396, 412, 120-B Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that petitioner is not named in the First Information Report. First Information Report is against unknown. There is no recovery from possession of the petitioner. Name of the petitioner has transpired in the confessional statement of co-accused, Lalan Singh. The petitioner was arrested in connection with Barh P.S. Case No.87 of 2017 on 11.04.2017 and has been remanded in

Patna High Court CR. MISC. No.15902 of 2019(2) dt.25-03-2019 2/2 this case on 22.05.2017. He is in custody since then. Petitioner has been implicated in this case because he is son of Shiv Shankar Singh.

Counsel for the petitioner further submits that coaccused, Shiv Shankar Singh, has already been granted regular bail by co-ordinate Bench of this Court by order dated 30.01.2019 passed in Cr. Misc. No.2297 of 2019. Petitioner is in custody since 22.05.2017.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge, III, Barh, Patna, in connection with Sessions Trial No.713 of 2017 arising out of Belchhi P.S. Case No.11 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
