JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 25-05-2016 These three applications for grant of pre-arrest bail arise out of Dulhin Bazar P. S. Case No. 204 of 2015 registered under Sections 147, 148, 149, 341, 323, 283, 332, 333, 307, 353, 427, 152 and 504 of the Indian Penal Code, as such, they have been heard together and are being disposed of by a common order.

Heard learned counsel for the petitioners and learned counsel for the State in these three applications. It is contended by learned counsel for the petitioners that co-accused Umesh Yadav having identical allegation to that of the petitioners has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 17.05.2016 passed in Cr. Misc. No. 17171 of 2016. He has further contended that two other co-accused, namely, Sant Yadav and Krishna Yadav have also been granted anticipatory bail by another co-ordinate Bench of this Court vide order dated 16.05.2016 passed in Cr. Misc. No. 15795 of 2016.

Learned counsel for the State concedes that the case of the petitioners stands on identical footing to that of other co-

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the respective petitioners of these three applications are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Danapur, Patna in Dulhin Bazar P. S. Case No. 204 of 2015, G. R. No. 5407 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
