The petitioner seeks bail in Kishanpur P.S. Case No. 202 of 2021 registered for the offence under Sections 379 and 34 of the Indian Penal Code.

As per the prosecution case, while returning home in the evening, when the informant stopped his motorcycle to urinate, two unknown persons came on motorcycle from behind and took away his bag containing valuables.

It is submitted on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this case. It is further submitted that petitioner is not named in the F.I.R. and his name transpired during the course of investigation. Petitioner is in custody since 05.11.2021 and he has

Learned APP vehemently opposes the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances and the period of custody, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Kishanpur P.S.
