JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-06-2020 Heard Mr. Ziyaur Rahman, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Kawakole P.S. Case No. 26 of 2017 dated 11.03.2017 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The petitioner is not named in the First Information Report and his implication in this case is on the basis of his being the registered owner of a motorcycle which was also recovered along with a Sumo vehicle from where 790 litres of liquor was recovered.

The petitioner is sixty six years of age and is also suffering from several illnesses. In the other case in which the petitioner has been made accused earlier, he has been granted bail.

Considering these aspects of the matter, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II -cum-Special Judge, Nawada in connection with Kawakole P.S. Case No. 26 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure (Ashutosh Kumar, J) sunilkumar/- U T
