Let his name be deleted from the list of advocates being printed in the cause list. Heard Mr. Dhananjay Kumar Tiwary, learned counsel for the petitioner and learned APP for the State. The petitioner has preferred this application for grant of regular bail in a case registered under section 302 and other sections of the Indian Penal Code.

As per the prosecution case, the eight named accused persons including the petitioner herein are stated to have come variously armed. It is stated that while accused Ravindra Singh and Arvind Singh caught hold of the son of the informant, all the accused persons assaulted him. Further accused Shankar Singh assaulted the son of the informant on his head with an iron rod

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations of assault is specific on co-accused Shankar Singh. The case of the petitioner stands on a similar footing to that of coaccused Abhimanyu Singh who has been enlarged on bail vide order dated 5.8.2021 passed in Cr. Misc. no. 17699 of 2021. The petitioner is in custody since 6.9.2020.

Having heard learned counsel for the parties and taking into consideration the facts of the case, grant of bail to co-accused Abhimanyu Singh and the petitioner having remained in custody for over one year, the petitioner is directed to be enlarged on bail in connection with S.Tr. no. 9 of 2021 (arising out of Shyampur Bhataha P.S. Case no. 151 of 2020) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District & Sessions Judge, Sheohar.
