JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 20-05-2016 Heard the counsel for the petitioner and the State. The petitioner is accused of Triveniganj P.S. Case No. 07 of 2016 instituted under section 379 of IPC and seeks anticipatory bail.
The motor-cycle of the informant while parked inside the house was stolen during night. The informant has suspected the petitioner as the person who committed the theft as he was employed as a driver of the tractor of his brother. The counsel for the petitioner states that except suspicion, there is nothing tangible on record to incriminate the petitioner in the crime. It was a dispute of wages which prompted the informant to name him on suspicion. The petitioner does not carry any criminal antecedents.

No.21721 of 2016 (2) dt.20-05-2016 2/2 Considering the above, the petitioner above named, in the event of arrest/surrender within four weeks from today, shall be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of ACJM Ist, Supaul in Triveniganj P.S. Case No. 07 of 2016 on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge, he shall appear on each date fixed at the trial. Failure in appearance on two consecutive dates shall entail cancellation of his bail bonds. (Kishore Kumar Mandal, J) HR/- U T
