2. The petitioner is apprehending his arrest in connection with Complaint Case No. 390 of 2023 for the offence under Sections 498A of the I.P.C.
3. As per the prosecution story, the complainant has alleged that her marriage was solemnized with the petitioner on 21.05.2021 according to Hindu Rites and Rituals. Thereafter, when she came to her matrimonial house, her in-laws as well as the present petitioner (her husband) started assaulting her and demanded Rs. 5,00,000/- (Five Lakh) and one motorcycle as additional dowry. After five days of marriage, when she did not fulfill the demand the petitioner has assaulted and driven her out from his house.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The

Learned counsel further submits that the petitioner has filed Matrimonial Case No. 276 of 2021 for restitution of conjugal right before the Principal Judge, Family Court, Bihar Sharif at Nalanda.
5. Learned counsel for both the parties have submitted that both the parties are ready to take mutual divorce from the competent Court after filing the case.
6. Keeping in view the aforesaid facts and above submissions made by learned counsel appearing on behalf of both the parties, this Court is inclined to extend him the privilege of anticipatory bail.
7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna City, in connection with Complaint Case No. 390 of 2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
