JUSTICE ARUN KUMAR ORAL ORDER 16-01-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the Informant. Petitioner, already in custody, seeks bail in Ara Nawada PS Case No. 663 of 2016 registered under Sections 302, 201, 34 of the IPC and Section 27 of the Arms Act.

Learned Counsel for the petitioner submits that the petitioner is not named in the FIR, rest two other accused persons are named in the FIR and there is no material against the petitioner except disclosure of his name in the alleged occurrence by two co-accused Neeraj Kushwaha and Raju Kumar. Neeraj Kushwaha, the named accused, has been granted bail by a coordinate Bench of this Court, the petitioner has no criminal antecedent and is in custody since 24.1.2017.

Having considered the said facts and circumstances, the petitioner, namely, Gautam Choudhary is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge, Bhojpur, Ara in connection with Ara Nawada PS

Patna High Court Cr.Misc. No.57141 of 2017 (3) dt.16-01-2018 Case No. 663 of 2016, with the condition that one of the bailors shall be a close family member of the petitioner.

The petitioner is directed to appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of medical emergency his bail bonds shall be liable to be cancelled.
