The petitioners are languishing in custody for the offence punishable under Section 379 of the Indian Penal Code. The FIR of the occurrence of theft is against unknown.

Submission is that the stolen motorcycle was recovered from the possession of the petitioner. The petitioner has got criminal antecedent. The petitioners are in custody since 29.10.2018. Investigation of the case is already complete. Considering the entire facts aforesaid and the period already undergone, let the petitioners, above named, be

Patna High Court CR. MISC. No.16329 of 2019(3) dt.17-05-2019 2/2 released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Madanpur P.S. Case No.181 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
