Having regard to the nature of allegation for offence under Section 366/34 of the Indian Penal Code and the fact that the petitioner was not only named in the F.I.R. by the brother of the victim girl to have forcibly taken way his sister but even the victim girl herself, after recovery, has named the petitioner in her statement recorded u/s 164 of the Cr.P.C., this Court is not inclined to grant anticipatory bail to the petitioner.
The prayer for anticipatory bail is hereby rejected. However, the petitioner may surrender and seek regular bail and if he does so, this order in any way will not prejudice him in getting regular bail to the petitioner.
