====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 15-07-2020 Heard the parties through the virtual court proceeding. The petitioners apprehend their arrest in connection with Complaint Case No. 5337(C)/2018 registered for the offences punishable under Sections 323, 504, 498A and 34 of the Indian Penal Code.
Allegation against the petitioners is of committing to torture upon the informant due to non-fulfillment of demand of dowry.
Patna High Court CR. MISC. No.16575 of 2020(2) dt.15-07-2020 2/2 Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. The petitioners are the inlaws. He further submits that earlier the complaint filed a written report before the Officer-in-charge, Delha Police Station on 09.12.2018 registered as Delha P.S. Case No.269 of 2018 dated 09.12.2018 under Sections 341, 323, 308, 498A, 379, 504, 506/34 of I.P.C. against the petitioners. Thereafter, again the informant filed the present complaint petition against the petitioners.
Learned A.P.P. for the State has opposed the prayer for bail.
In the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (twenty five thousand) each only with two sureties of the like amount each to the satisfaction of Smt. Divya Amal, J.M. 1st Class, Patna in connection with Complaint Case No. 5337(C) of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
