The petitioner seeks bail in Bhagwanganj P.S. Case No. 79 of 2021/S.T. No. 841 of 2021 registered for the offence under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the F.I.R., when the informant's husband was returning home from the market some miscreants opened fire on the him as a result of which he died.

It is submitted on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this case. It is further submitted that petitioner is not named in the F.I.R. and name of the petitioner transpired during the course of investigation in the confessional statement of Dipu Kumar and except confessional statement, there is no cogent material against

Patna High Court CR. MISC. No.17255 of 2022(2) dt.25-05-2022 2/2 the petitioner. It is further submitted that during the course of investigation, informant had raised suspicion against co-accused Dipu Kumar and had not whispered about the petitioner. Petitioner is in custody since 17.08.2021.

Learned APP vehemently opposes the prayer for bail of the petitioner.

Considering the aforesaid facts and circumstances, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, Masaurhi, Patna in connection with Bhagwanganj P.S.
