2. The present writ application has been filed for seeking direction to the respondent for grant of third A.C.P. of the petitioner and in this regard, the petitioner's representation (Annexure-4) is pending before the authority, Deputy Secretary, Water Resource Department, Patna.

3. Learned counsel for the State submits that since, petitioner's representation is pending and no counter-affidavit has come, as such this case may be disposed of directing the petitioner to file his fresh representation before the authority.

4. In this background, the present writ application is disposed of directing the petitioner to file his representation before respondent no. 3 within four weeks from today for his grievances and respondent no. 3 is directed to pass reasoned and speaking order within 90 days thereafter. Since, the election is going on, therefore, the said 90 days shall be counted from the date of end of the election.
