The petitioner seeks regular bail in connection with Jehanabad P.S. Case No. 389 of 2017 for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.
The allegation is regarding recovery of 594 liters of illicit liquor from a pick up van standing near the river. The name of the petitioner had transpired upon secret information received by the police that the said liquor was owned by the petitioner herein.
The learned counsel for the petitioner submits that neither the vehicle belongs to him nor anything has been
Patna High Court Cr.Misc. No.498 of 2018 (2) dt.18-01-2018 2/2 recovered from conscious possession of the petitioner. It is further submitted that the petitioner has a clean antecedent and he is in custody since 6.12.2017.
Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner has a clean antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Jehanabad in connection with Jehanabad P.S. Case No. 389 of 2017.
