JUSTICE SUDHIR SINGH ORAL ORDER 16-07-2015 Head learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 341, 323,307, 379 and 504/34 of the Indian Penal Code.

The prosecution story, in brief, is that petitioner no.1, Ram Karan Sah, gave farsa blow on the head of Sujit Kumar and petitioner no.2, Shyam Nandan Sah, gave iron blow on the temple of the informant.

It has been submitted on behalf of the petitioners that it is a case and counter case. It is further submitted that the injuries sustained by informant side are simple in nature. It is also submitted that the accused side have also sustained injuries, which have not been explained by the prosecution and the same

Patna High Court Cr.Misc. No.25955 of 2015 (2) dt.16-07-2015 2/2 cast serious doubt upon prosecution case.

On behalf of the State it has been submitted that the petitioners are named in the FIR.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar, in connection with Katihar Mufassil P.S.Case No. 16 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
