The petitioners apprehend their arrest in Beldaur P.S. case No. 276/2015 under Section 387 and some other sections of the Indian Penal Code and under section 27 of the Arms Act. The informant alleged that while he was carrying bamboo and sisam trees to his house the accused persons came and made objection and Rajeev Paswan, petitioner No.2, fired but that did not hit anybody. Co-accused Binod Paswan and Picho Paswan ran to assault the informant by Dabiya and demanded extortion of Rs. 10 lacs for taking possession of the land. It is submitted that the entire allegation is false and concocted. Some altercation took place as petitioners were
Patna High Court Cr.Misc. No.21781 of 2016 (3) dt.21-07-2016 2/2 keeping watch on the orchard and the same orchard was purchased by the informant.
Taking into consideration the fact that petitioners demanded extortion for taking possession of the land, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
