2. Learned counsel for the petitioners submits that vide order dated 16.04.2025, the bail application of the petitioner No. 2 was dismissed as withdrawn. Accordingly, he is now pursuing the bail application only on behalf of petitioner Nos. 1 & 3.

3. The petitioner Nos. 1 & 3 are apprehending arrest in connection with Kharagpur P.S. Case No. 200 of 2024, registered on 14.06.2024 for the offences punishable under Sections 341, 323, 325, 354 ([k), 504, 427, 179 and 34 of the Indian Penal Code.

4. As per the prosecution, FIR has been lodged against

No.22550 of 2025(3) dt.14-05-2025 2/3 seven named accused persons, including the petitioners, alleging that on 01.06.2024, at night, all the accused persons abused and assaulted the informant's father, for which the informant's father lodged a case bearing Kharagpur P.S. Case No. 183 of 2024. Thereafter, on 04.06.2024, the accused persons entered the informant's house armed with khanti, iron rods, and a pistol, and started misbehaving with the informant. Upon oppose, the petitioner No. 3, Sintu Singh, assaulted the informant. It is further alleged that accused Sintu Singh, took away Rs. 2,00,000/- in cash and jewellery worth Rs. 5,00,000/-.

5. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel further submits that petitioner No. 1 is aged about 75 years and has been unnecessarily made an accused in the present case. Counsel further submits that it is a case of political rivalry related to the PACS election, and with a view to humiliate the petitioners, the present case has been lodged. Counsel further submits that the criminal antecedents of the petitioners are not clean. There are two criminal cases pending against petitioner No. 1 and one criminal case pending against petitioner No. 3. Counsel also submits that there is a delay of 10 days in lodging the FIR, the date of occurrence is 04.06.2024, whereas the FIR was lodged on 14.06.2024.

6. Learned APP for the State opposes the prayer for bail and submits that two criminal cases have been filed against the petitioners within a span of four days, and there is a specific allegation against the petitioner No. 3 of making repeated attacks.

In the present facts and circumstances, let the petitioner No. 1, namely, Arvind Singh @ Mahendra Singh be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-IV, Munger, in connection with Kharagpur P.S. Case No. 200 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

8. So far as the bail application of the petitioner No. 3, namely, Sameer Suman @ Sintu @ Sintu Singh @ Sinhu Singh is concerned, his bail application is hereby rejected. (Dr. Anshuman, J.) Aman Kumar/- U T
