Petitioner seeks regular bail in connection with Dhibra PS Case No. 01/2022 registered for the offence punishable under Sections 30(a) of Bihar Prohibition & Excise Act, 2018.

The police recovered 277.5 litres of illicit liquor from Alto Car bearing Registration No. DL3CBU2733 and arrested one person, namely, Basant Kumar while another accused person succeeded in fleeing away.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of disclosure of his name by arrested accused person. No illicit liquor has been recovered from conscious possession of the petitioner or from the vehicle belonging to him. Petitioner has

Patna High Court CR. MISC. No.17444 of 2022(2) dt.25-05-2022 2/2 got no concern with the Alto Car from where recovery of illicit liquor has been made. The petitioner is in custody since 09.03.2022.

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner's name has figured in this case on the basis of disclosure of his name by arrested accused person, no illicit liquor has been recovered from his conscious possession or from the vehicle belonging to him, petitioner is in custody since 09.03.2022, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, IX-cumSpecial Judge, Excise Court-II, Aurangabad (Bihar) in connection with Dhibra PS Case No. 01/2022.
