JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2019 This application, for grant of anticipatory bail, arises out of Ismailpur P.S. Case No. 38/18, disclosing offences under Sections 147, 148, 149, 307 and 302 of the Indian Penal Code.
Prosecution case as per written report is that petitioner and other accused fired indiscriminately on the informant and his brother causing injury to brother of informant, who succumbed to his injuries.
Submission of learned counsel for the petitioner is that large number of cases are going on between the parties and due to which, he has falsely been implicated in this case. Further submission is that no specific allegation has been attributed to the petitioner of firing on the deceased.

No.17129 of 2019(4) dt.27-06-2019 2/2 Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner, if so desire, may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
