The petitioner apprehends her arrest in a case registered under Sections 406, 408, 409, 419, 420 and 34 of the Indian Penal Code.

According to the prosecution allegation, the informant, the Programme Officer of Ladania Block, lodged a case finding irregularities in execution of MGNREGA Scheme Nos. 04/011-12, 03/011-12, 02/011-12, 11/011-12, 07/011-012. Learned counsel for the petitioner submits that from perusal of Annexure-2, it would appear that an enquiry was held and some irregularities were found. The allegation was found to be true. The case was lodged against four persons, namely, Jangi Lal Mandal, Geeta Devi (the petitioner), Pankaj Kumar Mishra and Vijay Kumar Mishra. Pankaj Kumar Mishra and Vijay Kumar

Patna High Court Cr.Misc. No.33036 of 2014 (2) dt.09-02-2015 2/2 Mishra have already been granted anticipatory bail vide Cr. Misc. Nos. 2220/2014 and 54404/2013. The petitioner is the Mukhiya. On the other hand, learned A.P.P. opposed the prayer for anticipatory bail.

It appears that the petitioner and others are alleged to have misappropriated the amount sanctioned under MGNREGA Scheme but two accused persons have already been granted anticipatory bail on same and similar allegations. Considering the facts aforesaid, the above named petitioner, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in Ladania P.S. Case No. 29/2013 (G.R. No. 893/2013), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
