The vehicle of the petitioner is claimed to have been utilized by the Election Commission of India during the Legislative Assembly Election, 2010 as well as the Parliamentary Election, 2014. The grievance of the petitioner is that he has not been recompensed for utilization of the vehicle bearing No.BR-9E-5107 which was stated to have been utilized during the Legislative Assembly Election, 2010 and 8 numbers of vehicles utilized by the Commission during 2014 Parliamentary Election the details of which find mentioned in Annexure-2. Admittedly the petitioner has

Patna High Court CWJC No.8367 of 2016 dt.21-06-2016 not represented his grievance before the Election Commission of India and has approached this Court directly. In the circumstances discussed and for the present I deem it fit and proper to direct the petitioner to raise his grievance along with the supportive documents before the Deputy Chief Electoral Officer, Bihar, Patna who may be added as respondent no.8 during the course of the day and who shall consider the grievance of the petitioner and dispose of the same accordingly but after hearing the petitioner.

Needless to mention that in case the claim raised by the petitioner or any part thereof is found to be just and proper, the same may be paid to him within three months of the filing of the claim and in the event the same is not found to be acceptable, the same would be disposed of by a reasoned order. But in any event the disposal of the claim should be done within 3 months of its receipt.
