===================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-07-2018 The petitioner seeks bail in connection with Bihpur P.S. Case No. 443 of 2017 dated 25.10.2017 instituted for the offences under Sections363, 366(A), 341, 323, 504, 34 of the Indian Penal Code.

The grand-daughter of the informant did not return after she had gone out of the house to offer prayers in a temple. Later, the informant (grand-father) was told that the victim has been abducted by the petitioner. The informant, thereafter went to the house of the petitioner but the parents of the petitioner did not give any satisfactory answer. He, therefore suspected that perhaps the petitioner and his parents have abducted his grand-daughter for the purposes

Later, the victim was recovered who, in her 164 Cr.P.C statement has said that she has married the petitioner of her own volition because of a long standing affair with him. She has run away of her house because her parents wanted her to marry an old person. In her 164 Cr.P.C statement, the victim has described her age to be eighteen years.

The petitioner is in custody since 23.02.2018. Considering the aforestated facts, the petitioner above named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Naugachia, Bhagalpur in connection with Bihpur P.S.
