JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 23-05-2016 Heard learned counsel for the petitioners and learned counsel for the informant.
Despite repeated calls, none appears for the State. The petitioners seek pre-arrest bail in connection with Adapur P.S. Case No.11 of 2016 registered under Sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code. Regard being had to the direct and specific allegation of assault made against petitioner no.4, namely, Khatuna, I am not inclined to grant her pre-arrest bail. Accordingly, her prayer for grant of pre-arrest bail is rejected.
So far as other petitioners, namely, Akmal, Gofir Ali @
Patna High Court Cr.Misc. No.20667 of 2016 (2) dt.23-05-2016 2/2 Zafir Ali, Suleman, Sareha Khatoon @ Saresh Khatoon and Rehana Khatoon @ Rahna Khatoon are concerned in view of nature of allegation made against them, in the event of their arrest or surrender in the court below within six weeks from today, they are directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Katihar in connection with Abadpur P.S.Case No. 11 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
