JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-02-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State as also heard learned counsel, appearing for the complainant. Petitioners apprehend their arrest in connection with Complaint Case No. C-1/1307/12 in which, cognizance has been taken for the offence under Sections-498A of the Indian Penal Code.
From perusal of Annexure-5 to this petition, it appears that parties have settled their dispute amicably, and furthermore, Annexure-4/1 to this petition reveals that all the articles of the complainant had already been returned to her. The
Patna High Court Cr.Misc. No.33981 of 2014 (2) dt.10-02-2015 2/2 impugned order of learned Sessions Judge reflects that the grievance of the complainant is that the petitioner has not made payment as per compromise but learned counsel, appearing for the petitioner drew my attention towards paragraph-3 of Anexure-5 and submits that Rs 80,000/- had already been deposited by the petitioner before the concerned Mukhiya.
Although learned counsel, appearing for the complainant submits that no amount has been paid to the complainant but considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioners, named above, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Complaint Case No. C-1/1307/12 to the satisfaction of Chief Judicial Magistrate, Sitamarhi.
